Terms of Service

Welcome to Answerify ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of Answerify's AI phone agent, automation tools, and related services ("Service"). By accessing or using the Service, you agree to these Terms.

If you do not agree, you must discontinue use of the Service.

1. Description of Service

Answerify provides AI-powered call handling, booking automation, and related business communication tools. The Service is continually improving and may change without prior notice.

You understand and agree that:

  • The Service is not guaranteed to be error-free,
  • AI responses may occasionally be incorrect or incomplete,
  • Output will vary depending on inputs and context,
  • The Service is provided on a best-effort basis, and
  • You are responsible for verifying the accuracy of any information before relying on it.

2. Eligibility

You must be at least 18 years old to use the Service. If you use the Service on behalf of a company, you represent that you are authorized to bind that company to these Terms.

3. Your Responsibilities

You agree to:

  • Provide accurate business information
  • Maintain the security of your account
  • Comply with all applicable laws
  • Use the Service only for lawful purposes
  • Not use the Service for emergency response, regulated advice, or illegal activities
  • Monitor the accuracy and suitability of AI-generated messages or call handling

You understand that you are responsible for any actions taken by your end users or customers when interacting with your Answerify agent.

4. Payment, Billing & Refunds

4.1 Subscription Fees

Use of the Service may require payment of recurring subscription fees and/or one-time onboarding fees. Pricing may change over time, and you will be notified before any increase takes effect.

4.2 Billing

Subscriptions renew automatically unless canceled. By subscribing, you authorize us to charge your payment method automatically.

4.3 Refunds

Fees are non-refundable unless required by law. We may, at our discretion, issue credits or refunds in special cases.

If the Service is discontinued or terminated by us, your subscription will remain active until the end of your current billing period.

5. Service Availability

We strive for high availability but do not guarantee:

  • Uninterrupted uptime
  • Real-time response accuracy
  • Error-free operation
  • Perfect audio quality or call handling

We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice if discontinuation materially affects paid users.

6. AI Limitations & No Guarantee of Outcomes

You acknowledge:

  • AI may misunderstand callers
  • AI may respond inaccurately
  • Bookings may fail or be delayed
  • Integrations may occasionally break
  • Call quality may vary based on carrier, network, or third-party services

Accordingly:

  • Answerify does not guarantee any specific business outcome, including lead volume, bookings, revenue, or call accuracy.
  • You agree to use the Service at your own risk and verify important information manually.

7. Third-Party Services

The Service integrates with third-party platforms (e.g., OpenAI, Twilio, Stripe, Google Calendar).

You agree that:

  • We are not responsible for failures or downtime of these providers
  • Data may be transmitted and processed by third parties
  • You must comply with their terms as well

We disclaim all liability related to third-party services.

8. Data, Privacy & Call Recording

You grant us permission to:

  • Process call audio, transcripts, and metadata
  • Store information needed to deliver the Service
  • Use anonymized and aggregated data to improve our models

You represent that you have obtained any required consent from your callers for call recording or automated interactions pursuant to applicable laws.

9. Intellectual Property

All software, models, documentation, and content provided by Answerify remain our property. You may not copy, reverse engineer, or resell the Service.

10. Termination

Either party may terminate at any time.

We may suspend or terminate access if:

  • You violate these Terms
  • Your payments fail
  • Your usage threatens system stability
  • You misuse or abuse the Service

Upon termination, access ends immediately, and data may be deleted after a reasonable retention period.

11. Disclaimer of Warranties

To the fullest extent permitted by law:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee the Service will meet your requirements, be accurate, or operate without interruption.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, consequential, or punitive damages
  • Our total liability for any claim will not exceed the amount paid by you in the 30 days prior to the claim
  • We are not liable for lost revenue, missed calls, lost bookings, or business losses arising from AI output or system errors

This limitation applies even if we were advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold Answerify harmless from any claims, losses, or damages (including legal fees) arising from:

  • Your misuse of the Service
  • Your violation of laws or these Terms
  • Your interactions with your customers

14. Governing Law

These Terms are governed by the laws of the United States and the State of Florida, without regard to conflicts of law principles. You agree to exclusive jurisdiction in that state.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance.
